1. Agreement

These Terms of Service ("Terms") govern your use of thankyoubabyai.com and the video generation service offered there (the "Service"), operated by Thank You Baby AI ("we", "us", "our"). By creating an account, buying credits or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

The Service lets you upload a photo of a person and receive a short AI-generated video (currently about 15 seconds, vertical 9:16, 480p, with music) in which that person performs the "Thank You Baby" dance routine in the scene of your photo.

Videos are created by a third-party AI model. Results vary with the photo and may contain visual errors, distortions or inaccuracies. We do not guarantee any specific likeness, quality or outcome.
Generation usually takes a few minutes but may take longer.
We may change, improve or discontinue features, the dance template, output specifications or models at any time.

Thank You Baby AI is an independent tool. It is not affiliated with, endorsed by or sponsored by the creators of the original "Thank You Baby" trend or any platform where it appeared.

3. Eligibility and Accounts

You must be at least 18 years old and able to form a binding contract to use the Service.
You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account.
One person may not use multiple accounts to abuse promotions or avoid restrictions.

You may only upload photos that you have the right to use. Specifically, by uploading a photo you confirm that every person shown in it is:

you;
your own child (or a child for whom you are the legal guardian); or
an adult who has given you permission to use their photo to create an AI-generated video.

You also confirm that you own the photo or have the necessary rights to it, and that using it does not violate anyone's privacy, publicity, copyright or other rights.

5. Prohibited Uses

You agree not to upload content or use the Service to:

create videos of any person without the permission described in Section 4, including celebrities, public figures, or private individuals you do not have consent from;
create sexual, nude, sexually suggestive or exploitative content of anyone, and in particular any content that sexualizes or endangers a minor, which we will report to the relevant authorities;
harass, bully, defame, humiliate, threaten or impersonate anyone;
create deceptive content intended to mislead others into believing an AI-generated video is real footage, including for fraud, scams, political manipulation or misinformation;
promote violence, hate, self-harm or illegal activity;
infringe intellectual property or other rights of any third party;
remove or obscure any indication that a video is AI-generated where such labeling is required by law or platform rules;
interfere with, overload, reverse-engineer, scrape or gain unauthorized access to the Service, or automate access in ways we have not authorized;
resell or provide the Service to third parties without our written permission.

We may refuse to process, remove or delete any content, and suspend or terminate accounts, that we reasonably believe violate these Terms. Credits used on content removed for violating these Terms will not be restored or refunded.

6. Credits, Pricing and Payment

The Service uses prepaid video credits. One credit = one video generation. Credits are sold in packages (currently 1, 4 or 7 videos) at the prices shown on the site at the time of purchase. There is no subscription and no automatic renewal.
Payments are processed by Stripe. By purchasing, you also agree to Stripe's terms. Prices are in US dollars and may exclude taxes, which will be shown at checkout where applicable.
Credits are added to your account after payment is confirmed. Credits are personal to your account, have no cash value, and cannot be transferred, resold or exchanged.
Credits do not expire while your account remains active. Unused credits are forfeited if you delete your account or if it is terminated for violating these Terms.
We may change prices for future purchases at any time. Changes do not affect credits you have already bought.

7. Failed Generations and Refunds

Failed generations: if a generation fails for technical reasons, the credit used is automatically restored to your account. A restored credit is not a cash refund.
Unused credits: you may request a refund of a purchase within 14 days of purchase, provided none of the credits from that purchase have been used. Email support@thankyoubabyai.com with your account email and order details.
Used credits: because each video is a custom digital product delivered immediately upon generation, credits that have been used to generate a video are non-refundable, including when you are unhappy with the artistic result. If you believe a video is clearly defective (for example, it is blank, corrupted or does not show the uploaded person at all), contact us within 14 days and we will review it and may restore the credit at our discretion.
Duplicate or unauthorized charges: contact us and we will investigate and correct genuine billing errors.
This section does not limit any non-waivable rights you have under applicable consumer protection law.

8. Ownership and License

Your content. You keep all rights you have in the photos you upload. You grant us a limited, worldwide, non-exclusive, royalty-free license to store, process and transmit your photos, and to share them with our service providers, solely to operate the Service and generate your videos. We do not use your photos or videos to train AI models and do not publish them without your separate permission. This license ends when the content is deleted, except for copies held for the limited periods described in our Privacy Policy.

Your videos. As between you and us, and to the extent permitted by law, we assign to you any rights we have in the videos generated for you. You may use them for personal and non-commercial purposes, such as sharing with family and friends or posting on social media. Please note:

the dance choreography and music in the template are based on a third-party trend; we do not grant you rights to that underlying material, and commercial use (for example, in advertising) is at your own risk and may require separate permission from the rights holders;
AI-generated content may not be eligible for copyright protection in some jurisdictions;
you are responsible for how you use and share your videos, including following the rules of any platform you post to.

Our Service. The Service, including its software, design, branding, text and template materials, belongs to us or our licensors and is protected by law. Except for the rights expressly granted here, you receive no rights in the Service.

9. Storage and Deletion

We store uploaded photos for up to 30 days and generated videos for up to 90 days, after which they may be deleted automatically. The Service is not a backup or storage service — download any video you want to keep. We are not responsible for content deleted after these periods or when you delete your account.

10. Reporting Misuse

If you believe a video or photo on the Service shows you or your child without permission, or otherwise violates these Terms or your rights, email support@thankyoubabyai.com with enough detail for us to identify the content. We will review reports promptly and remove content where appropriate.

Copyright complaints: send a notice to the same address including your contact details, identification of the copyrighted work, identification of the material you claim is infringing, a statement of good-faith belief that the use is unauthorized, a statement that your notice is accurate and, under penalty of perjury, that you are authorized to act for the rights owner, and your physical or electronic signature.

11. Third-Party Services

The Service relies on third parties, including Cloudflare (hosting and storage), Kie.ai and its model providers (video generation), Stripe (payments) and Google (sign-in and analytics). Their services are governed by their own terms, and we are not responsible for their acts or omissions, outages or changes.

12. Termination

You may stop using the Service and delete your account at any time in Settings → Security.

We may suspend or terminate your access, with or without notice, if you violate these Terms, if we are required to by law, or if we discontinue the Service. If we discontinue the Service entirely for reasons other than your breach, we will refund the purchase price of your unused credits.

Sections that by their nature should survive termination (including Sections 5, 7–8 and 13–16) will survive.

13. Disclaimers

THE SERVICE AND ALL VIDEOS ARE PROVIDED "AS IS" AND "AS AVAILABLE". TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT GENERATED VIDEOS WILL BE ACCURATE OR MEET YOUR EXPECTATIONS.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

15. Indemnity

You agree to indemnify and hold us harmless from any claims, damages and expenses (including reasonable legal fees) arising from content you upload, videos you create or share, or your violation of these Terms or any third party's rights.

16. Disputes

Before filing any claim, please contact us at support@thankyoubabyai.com so we can try to resolve the issue informally; most concerns can be settled quickly this way. If a dispute cannot be resolved within 30 days, either party may pursue it in a court of competent jurisdiction. If you are a consumer, you retain the protection of the mandatory laws of your country of residence and may bring claims in your local courts.

17. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date and, for material changes, notify you by email or on the Service before they take effect. Continuing to use the Service after changes take effect means you accept the updated Terms.

18. General

These Terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. If there is any conflict between language versions of these Terms, the English version prevails.
